The Decision
1.That following the conclusion of:
the due diligence exercise since the selection of the Private Sector Partner in February 2018;
the Gateway Review meeting held 2nd September 2019;
the Senior Officer review meeting held 10th March 2020;
the Senior Officer review and Member briefings held 25th and 29th June respectively;
finalisation of the terms of the documents listed in Appendix 5 and any other required documents (“the Documents”); and
consultation by the Assistant Director (Property and Facilities) with the Director of Culture, Communities and Business Services, the Director of Corporate Resources and the Head of Legal Services
in accordance with the delegated approvals secured within reports to theExecutive Member for Policy and Resources 7th February 2018, 24th July 2018, 20th June 2019 and 25th July 2019 (as summarised within the report below) the Assistant Director (Property and Facilities) authorises the Head of Law and Governance and Monitoring Officer to enter into the documents listed in Appendix 5 (and any other required documents) and;
2.That following the finalisation of the terms of resolutions of Manydown Garden Communities Limited Liability Partnership (“MGC LLP”) and resolutions of the joint venture limited liability partnership (“DevCo”)
in accordance with the delegated authorities secured within the report to the Executive Member for Policy and Resources of 5 March 2020 (as summarised within the report below) the Assistant Director (Property and Facilities) authorises the Head of Law and Governance and Monitoring Officer to sign on behalf of the County Council (1) as a member of MGC LLP, the written resolutions of MGC LLP included within Appendix 5 and (2) as a member of MGC LLP, acting as a member of DevCo, the written resolutions of DevCo included within Appendix 5.
